Property in Kazakhstan: Almaty and Astana for foreigners

October 15, 2026

What foreigners can own in Kazakhstan, the residence-permit condition for housing, Almaty and Astana prices, taxes and bank checks, with a section for Russian speakers.

Kazakhstan is the largest economy in Central Asia, and Almaty and Astana have the country's most active housing markets. For foreign buyers the rules are stricter than in Armenia or Georgia: agricultural land is closed to foreigners, and Kazakh media and law firms say that an individual foreigner needs a residence permit to register housing in their name. We could not find the statutory article for the second point, so we present it as reported and recommend you confirm it with a notary before any payment. Prices and rules are as of October 2026.

What foreigners can and cannot own

  • Agricultural land. Foreigners, stateless persons and legal entities with foreign participation cannot own or hold agricultural land, as summarised by a Morgan Lewis note on restrictions for non-residents; a 2021 law reinforced the ban according to news reports. Land can be leased instead.
  • Frontier zone. Land in the frontier zone cannot be owned by foreigners (same Morgan Lewis note).
  • Other land. Law-firm and media summaries say that foreigners can lease non-agricultural land for terms of up to 49 years, and that residential plots are a topic for a lawyer, not an assumption.
  • Housing. Several Kazakh outlets (Krisha.kz, New Times and others) state that a foreigner can become the owner of an apartment or house only if they hold a residence permit, and that temporary registration is not enough. We could not verify the article of the law and the practice of registration authorities may differ, so ask a notary in writing. This is the single most important question to settle before reserving a flat.

We deliberately do not describe workarounds. If you hold only a visa or temporary registration, the correct step is to ask a Kazakh lawyer what is lawful for your situation.

Residence in Kazakhstan

We found no residence route in Kazakhstan that is based on buying property. A permit is normally linked to work, family, study or other statutory grounds, and sources mention proof of funds. Holding a permit does not by itself make you a tax resident: Kazakhstan's Tax Code, in force in 2026, tests the centre of vital interests, of which the permit is only one element. Details are in the law and at gov.kz, which is the official portal @@www.gov.kz@@. If you plan to live there, plan the permit first and the purchase second.

Prices in Almaty and Astana

Official and listing-based sources give different pictures, and they should not be mixed.

  • Bureau of National Statistics, January 2026 (reported by zakon.kz): about 690,668 tenge per square metre in Almaty and 671,200 in Astana, with a year-on-year rise of 19.8% in Almaty and about 15.7% for the national average (571,220 tenge).
  • Krisha.kz listings, July 2026 (reported by Finratings.kz): about 786,672 tenge per square metre for resale flats in Almaty, down 2.3% since the start of the year after a peak near 822,955 in March, and about 595,610 in Astana, up 4.1% since the start of the year.

The difference reflects method, since one series is statistical and the other is asking prices in listings, and they disagree on which city is more expensive. So the cautious reading is: both cities are in the range of roughly 600,000 to 800,000 tenge per square metre for typical flats, Almaty cooled in 2026 while Astana kept rising, and your own flat can be far above or below. We do not convert to dollars because the rate moves. Compare with other markets in property prices per m2 by country.

Taxes

  • Sale. According to Kazakh tax-service materials, from 1 January 2026 the new Tax Code requires a two-year holding period to avoid tax on the sale of a home bought in 2026 (one year for flats bought in 2025), with a 10% rate on gains up to 8,500 monthly calculation indices and 15% above; for commercial property the holding period does not exempt. We read this in summaries of the tax service press releases; check the actual rule before selling.
  • Rent. Summaries say non-residents pay 10% on Kazakh-source income. Check how rent is declared in your case.
  • Property tax. A progressive annual tax starts at 0.05% for low-value property (reported). Ask the tax office for your rate.
  • Your home country. An EU resident is taxed at home on foreign income and may need to report it. See tax on foreign rental income for Polish residents for an example, and rental yield by country.

For Russian-speaking buyers

Main risks

  • Ownership eligibility: signing or paying before confirming that you may register housing.
  • Price data quality: asking prices differ from statistical averages and from deal prices.
  • New-build delays and developer risk; ask for the permit and the payment schedule.
  • Currency: the tenge moves against the dollar and the euro.
  • Rules in the 2026 Tax Code are new and interpretations may change.
