Montenegro: cross-border payments and closing
Montenegro · Payments and closing · facts checked 2026-10-11
Montenegro uses the euro, which removes one hurdle for a buyer abroad, but since 12 May 2026 the route the money takes is regulated more tightly. This briefing explains the rule, the notary's role, the taxes and the registration step, and how to run a closing when the buyer is not in the country.
The EUR 10,000 rule
A law-firm note on the amendments to the anti-money-laundering act, in force from 12 May 2026, reports the following for real estate.
- A transaction involving a payment of EUR 10,000 or more may be carried out only if at least one party has a transaction account with a Montenegrin bank.
- A payment of EUR 10,000 or more, including a series of related payments, must be made by wire transfer to an account at a credit institution in Montenegro. Cash payments of that size are excluded.
- If the buyer paid before the notarisation, the notary must obtain documentary proof; the parties' own statement is not enough. A notary may not certify documents designed to bypass the national payment system.
In practice, a buyer who holds accounts only abroad sends the money to the seller's account at a Montenegrin bank, or opens an account in Montenegro first. A broker article reports that banks ask non-residents to show a connection with Montenegro and that opening accounts takes longer for some nationalities. Treat that as a reason to start early, and confirm the current procedure with the bank.
Stages of a purchase
- Due diligence: the land registry entry, the seller's basis of ownership, encumbrances and planning parameters.
- A preliminary agreement or the main contract, with the deposit paid by the route above.
- The contract signed before a notary. A sales contract is not valid without it.
- Tax and administrative steps after the notarisation.
- An application to register ownership in the cadastre. Sources say the buyer normally has 15 days from the acquisition to apply and that the office has a statutory decision period of the same length for an ordinary application. One source adds that from July 2026 notaries can file the documents electronically; this is a single source, so ask the notary.
Taxes and costs
- Transfer tax of 3 per cent is reported to be paid by the buyer within 15 days of the contract. Sources conflict on whether it also applies to new buildings: one says it applies only to resale property and that purchases directly from a developer carry VAT instead; another says it applies to both. Ask the notary or the tax office which regime applies to the property in question.
- VAT at 21 per cent is reported on developer sales.
- Registration fees are reported at about EUR 500.
- Notary, lawyer and translator fees depend on the case.
- Agent commission is usually paid by the seller according to one summary, but follow your own agreement.
Running a closing when the buyer is abroad
- Agree the price and stages in writing in a language the buyer reads.
- Name the Montenegrin account that will receive the money and confirm it with the bank before the buyer sends anything.
- Collect the documents for the funds before the deposit.
- Prepare a power of attorney if the buyer will not attend. Ask the notary how a document signed abroad must be certified or apostilled and translated, and who can act.
- Book the notary appointment once the contract text is final, and have the translator available.
- After the notarisation, pay the tax within the deadline and file the registration, then send the buyer the proof.
Pitfalls to flag to remote buyers
- Paying a deposit in cash or to an account abroad. Under the new rule it may not be accepted.
- Paying before the notarisation without a document that shows the payment.
- Assuming the tax regime without checking whether the property is a resale or a developer sale.
- Underestimating how long banks and the cadastre take.
- Signing in a language you cannot read.
How long it takes
Plan for the stages to run one after another rather than in parallel. The tax is due within a short window after the contract, the cadastre application follows within about 15 days, and the office has a similar period to decide an ordinary application. Bank steps for a non-resident can add days or weeks, especially when an account has to be opened first. Give the buyer a realistic range and update it when a step is confirmed, instead of promising a completion date at the start.
What to tell the buyer
Give a one-page sequence with the money route, the documents for each step and who is responsible. Say that rules were tightened in May 2026 and that you will confirm the current procedure with the notary and the bank before the deposit.
Working with D.H. Realting
D.H. Realting is a trilingual (Russian, English, Polish) overseas-property platform. We introduce buyers, including expats and cross-border buyers, to property in other countries and support the process. Agencies that handle the deal locally and want to be introduced to such buyers can contact us through our partners page. We do not publish commission terms or promise any volume of enquiries here; those are discussed one to one.
