Ownership rules for foreigners in Azerbaijan, registration, the AZN 100,000 residence basis, taxes, Baku prices and risks, with a section for Russian-speaking buyers.
Baku is the only large property market in Azerbaijan that foreign buyers use in practice, and prices there kept rising in 2026. According to our news report, Baku property prices rose 8.5% in Q2 2026, with new builds up by more than 11%. Buying is open to foreigners with one clear limit, land, and one useful feature: a property worth at least 100,000 manats can be a basis for a temporary residence permit. This guide explains the rules, the registration, the taxes we could find and the risks. It is as of October 2026, and many figures here come from law-firm summaries rather than the official texts, so we say where to verify.
Can foreigners buy property in Azerbaijan
Foreign citizens and stateless persons can buy a house, apartment, villa or commercial premises in Azerbaijan, but not land (this is how the Azerbaijani foreign ministry's information pages and local law firms describe it; we did not open the Civil and Land Code texts). Foreigners can lease land, and law-firm guides mention terms of up to 99 years. For an apartment in a building this limit rarely changes anything, but it matters for a house with a plot, so ask your lawyer how the plot is treated in the contract.
Registration, extract and title
Every sale must be registered in the state register of real estate, which is run by the State Service for Registration of Real Estate under the State Committee on Property Issues. Registration is what gives you full legal ownership. In practice you get an extract from the register that names you as owner. Before paying:
- Request an extract for the flat to see the owner, the area, any mortgage, pledge or arrest.
- Check that the seller is the registered owner and has the authority to sell, and whether a spouse's consent is needed.
- For a new build, check the developer, the building permit and how the area is measured in the contract.
- Have the contract translated and read it fully before signing; the working language of documents is Azerbaijani.
Residence permit through property (verify)
Under article 45.0.3 of the Migration Code, as quoted by Baku law firms and by Caspian Legal Center from State Migration Service explanations, owning real estate worth at least 100,000 manats (AZN) is a basis for a temporary residence permit. The sources add that the property must be registered in your name and, in most cases, be residential. A fixed-term deposit of at least the same amount in an Azerbaijani bank is mentioned as an alternative basis. We could not open the State Migration Service website to confirm the current wording, the permit duration or the valuation method, so check the threshold, the documents and the processing time with the service or a lawyer before treating this as a reason to buy. The manat is officially pegged at about 1.70 per US dollar, so 100,000 manats is roughly 59,000 dollars.
Baku prices in 2026
Our news report puts the year-on-year rise at 8.5% in Q2 2026, with new builds higher. A recent market overview that we found gives indicative ranges per square metre: about 1,800 to 2,800 manats for resale flats, 2,700 to 3,400 for mid-segment new builds and 3,500 to 5,500 for prime or branded projects. These are one source's ranges, not official statistics, and the best central streets and sea-view towers sit above them. Use them to sense-check an offer and then ask the agent for comparable prices actually paid. See also the comparison in property prices per m2 by country.
Taxes and costs
- Property tax. Summaries describe a municipal tax per square metre of residential area, about 0.1 to 0.4 manats, with the first 30 square metres exempt. Rates vary by location; ask the municipality for the rate on your flat.
- Rental income. A 14% withholding tax on rent paid to non-residents is described in a tax summary, and a plan to lower the residential rent tax to 10% was reported in the press. We have not confirmed which rate applies today.
- Sale and purchase. We found no reliable official figure for the transfer tax, so ask your lawyer for a written breakdown of state duties, notary and agent fees.
- Your home country. If you live in the EU, your country of residence will tax income from abroad. See tax on foreign rental income for Polish residents as an example.

For Russian-speaking buyers
- Language. Russian is widely understood in Baku in business and real estate, but contracts and the register are in Azerbaijani; order a certified translation.
- Community. Baku has a large Russian-speaking population and services, so doctors, schools and tenants are easy to find. See Russian-speaking communities and services by country.
- Documents. Foreign documents normally need an apostille or legalisation plus translation; see documents from Russia and the CIS for a purchase abroad.
- Banks and payments. Banks ask for proof of the source of funds. If money comes from Russia or through Russian banks, sanctions-related compliance can slow or block transfers, and your EU bank may ask additional questions. Plan for that, keep documents, and use regulated channels only. See bank checks for Russian citizens living in the EU. We found no rule that bars buyers by citizenship, but ask a lawyer about your specific passport.
Main risks
- Valuation and the 100,000 manat basis: a lower registered price than the real price would undermine a permit and is a legal risk; the contract should show the true price.
- Developer risk and delays in new builds.
- Thin resale market for some buildings and a single large city.
- Currency: the manat is pegged to the dollar, while your costs may be in euros.
- Official information is mostly in Azerbaijani, so check translations of decisions.
